Reporting By Electronic Means

Reporting By Electronic Means

Reporting by electronic means

Because notifying the litigants in a form and manner that is effective has a clear impact on completing cases and deterring procrastinators. Royal Decree No. M/18 was issued on 15/1/1442 AH amending Article 218 of the Penal Procedure Law and adopting electronic means in judicial notifications.
Circular No. 1020 / T was also issued on: 4/5/1439 AH to all courts to adopt notification by electronic means.
Notification through electronic means is considered to produce its statutory effects, and notification is to the addressee according to the following:
1/ Text messages via mobile phone.
2 / email.
3/ Governmental automated systems.

The notification must fulfill the following data:
1/ Name of the plaintiff or objector.
2/ The subject of the report.
3/ The name of the court, its location and the circuit.
4/ The time and date of the session.
5/ A copy of the statement of claim or an electronic link to access its content.

The notification by electronic means is considered delivered unless a notice of non-delivery is received, or the informant proves from the competent authority that he did not receive it. It is not the same as reporting by traditional means, in which it is only allowed in the place of residence, after sunrise and before sunset, and that it be during official working days.

With the exception of the provisions related to informing the arrested prisoner.
