The Rights System Of Older Persons

What is an older person’s rights and welfare system?

Who is elderly according to the system: Every citizen aged 60 years and over

His rights: are all the legal or systemic rights of the older person, including his financial, physical, social and moral rights.

Care shall be provided with the necessary housing, food, clothing and physical, psychological, social and recreational needs of the elderly.

One of the most important rights recognized by the system is that an older person should not be housed in social care homes until he or she has consented.

The provisions of the Regulations apply when an older person is incapable of securing the necessities of life in whole, or in part, because of his or her limited financial, physical, psychological or mental capacity.

The system prioritized the maintenance of the elderly as follows: The maintenance of the husband or wife is a priority, if this is not possible for his father if he is capable and then one of his male children, if this is not possible for one of his male grandchildren, if this is not possible for one of his male brothers.

The duty to support may also be transferred to the person chosen by the elderly with the first of them. In the event of disagreement or non-maintenance by any family member, the competent court shall determine the breadwinner’s family member, taking into account the interest of the elderly person.

Maintenance is also in accordance with the requirements of legal maintenance. When the breadwinner is unable to provide the necessary expenses, and none of his family is able to support him, the Ministry of Human Resources and Social Development must pay for the maintenance assistance.

Institutions in the public interest must prioritize older persons’ access to basic services, especially health and social services. The Ministry provides older persons with a privilege card enabling them to benefit from these services and to expedite and complete their procedures.

The following penalties shall be established in the event of a violation of its provisions:

Anyone who contravenes article 3, which stipulates that: “The elderly person shall have the right to live with his or her family and shall shelter and care for him or her.” –

– Anyone who acts in an older person’s property without his consent, willfully misbehavior the property of an older person who is entrusted with the power to act and willfully violate the protection and care of his rights shall be punished.

– The following:

1/Imprisonment for a term not exceeding one year

2/Fine not exceeding 500,000 rials.

It must be noted that these penalties are not imposed if the breadwinner is the father and wife.

The penalty shall be doubled, not exceeding the maximum limit prescribed in the event of a repeat offence.

He approved the following penalty for private social care homes, or eligibility for failure to take the consent of the elderly, for failure to give the elderly priority in access to services, and for failure to grant the deductibles to public services within the powers conferred by a system

– A fine not exceeding 100,000 rials.

The system applied the policy of alternative penalties by allowing the court competent to sentence the alternative punishment, provided that the penalty was in the service of the elderly.

Such as: working in care homes for the elderly.

 

The competent authority for investigating irregularities: the Public Prosecutor’s Office.

A complaint may be lodged before the Administrative Court.
